Terms of Use – Background and Purpose

This policy is intended to be a guide to all users, recipients of data, administrators, members of the public or any other person who may view, access or use a Surf Life Saving (SLS) application, website or database or the related data contained in such a system.

These systems include but are not limited to SurfGuard, Library, websites, ABSAMP, IRD, Member Portal/ Self Service application, Smart Device application, Voice Recognition application, Forum, Electronic Form, SLS Social media platform or any other system that may be used by an Officer, staff member, member of AESS (including a member of its affiliated SLSA clubs, branches and State/Territory and auxiliary associations) or member of the public.

In addition this policy seeks to protect the privacy of AESS employees and their personal details as well as the integrity of information contained in AESS systems.  The policy of AESS outlines the responsibilities of users of such systems.

In this policy, the expression “you” is a reference to all users, recipients of data, administrators, members of the public or any other person who may view, access or use an SLS application, website, database or any other IT system or the related data contained in such a system.

References made to AESS in this policy are also references made to SLS and vice versa.

 

User Responsibilities

The following statement outlines the responsibilities of people using any IT system made available or provided by the AESS (including but not limited to clubs, branches and State/Territory and auxiliary associations) where data may be entered, viewed or amended.

By using an application, database, IT system or website made available or provided by the AESS (“IT System”) you acknowledge and agree that:

  1. by logging-in to an IT System  you have agreed to these terms of use and to abide by and act in accordance with this policy;
  2. you are responsible for any user content posted by you on an IT System.  You warrant that all user content entered into any IT System or posted on the AESS website by you:
  3. is true and correct;
  4. is not misleading or deceptive, defamatory or obscene;
  5. does not infringe a third party’s intellectual property rights; and
  6. can be lawfully published by AESS;
  7. only information relating to you or relevant to your duties as an officer or staff member of a SLS entity will be accessed by you;
  8. you will not change or enter any information or records relating to you except personal contact information or information that any person may change themselves through an online system. Any changes to your information outside of the personal details exception should be made by the next highest authority – for the avoidance of doubt, the SLS hierarchy for the purposes of this paragraph are: Club, Branch State, AESS/SLS (national).  Where you believe you should be entitled to change your own records (as no conflict of interest arises, either real or perceived), you must consult the next highest authority and obtain written permission to do so before such changes are made;
  9. information in an IT System relating to a person will only be released in accordance with the SLSA Privacy Policy;
  10. you will abide by any other SLSA policy including but not limited to Social media use, Electronic Signatures, Photography and member wellbeing Policies;
  11. you will advise AESS when you no longer need a login so that the access can be terminated;
  12. your Club/Branch/State/National AESS may revoke individual access to any IT System and you agree you shall not attempt to re-activate access without authorisation. If a dispute arises with access, SLS IT shall require minuted proof of any decision made;
  13. you will not knowingly give another person your password or access to any IT System without first obtaining the written permission of AESS and following the proper login procedures;
  14. to protect the integrity of the data contained in the IT Systems, AESS will monitor usage within the IT Systems.  You acknowledge that you are aware of and agree to this monitoring;
  15. when using IT Systems you are governed by and must act in accordance with the SLSA Constitution, By-Laws, Regulations, Policies (including but not limited to the SLSA Privacy Policy) and the Surf Life Saving Standard Operating Procedures relating to processes facilitated by any IT System – such policies and procedures can be viewed on the SLSA website or a copy can be provided upon request;
  16. no personal information relating to any member or person will be accessed, viewed or amended by you except for the reasons or purpose of carrying out the job, role or function delegated to you by AESS or your Club, Branch or State and where such access, viewing or amendment is part of the role defined in your access application and/or position description.  For the avoidance of doubt you cannot use any IT System or any information in an IT System for a personal reason or material personal benefit or to the prejudice of any other person;
  17. communication at a club/branch level to/with members who are under the age of 18, using data obtained from an IT System shall be only permitted when approved by a relevant parent/guardian. The parent/guardian can enact the “Do not send” function at their own discretion for a minor under their care. If unsure, a user should seek advice and/or approval from their SLS entity management committee;
  18. you shall ensure that any device that you use to access data on any secured system provided by AESS shall be protected from malicious code, unauthorised access, malware or any other unintended access or use by means of antivirus software, passcode, encryption and or any other accepted means to prevent such malicious access on your device;
  19. if you are an Officer and/or Staff member of AESS, State, Branch, Club or other external or affiliated organisation responsible for any web based system or site relating to surf lifesaving, you shall make every effort to ensure that this social media site, website, system or other web/browser accessed conforms to this and any other SLSA related policies;
  20.  access by any person (including logins, passwords and permissions) to any IT system or system provided by a State, Branch or related external entity will only be used as they were allocated or intended (as part of a job role or function) by the system administrator and no person shall use another person’s login, password or permissions without specific permission from that systems administrator (or CEO in the case of a staff related access query) ; and
  21. any breach of this policy may result in disciplinary and/or legal action being taken by AESS (or relevant SLS entity) against you.

Website and IT Systems – General Usage Policy

The following statement outlines the responsibilities of people (i.e. recipients of data) such as members of the public, an AESS member or other interested party who may view or interact with an IT System.

  1. Use of the AESS website (“Website”) and the facilities thereon (including, but not limited to, the use of any IT Systems accessible on the Website) and any material or information obtained from this Website is at your own risk, and the AESS hereby expressly disclaims, to the fullest extent permitted by applicable law, all warranties, express or implied, of any kind including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and infringement.
  2. The AESS will not be responsible for the failure in performance of the Website, any IT System and/or the software used thereon or obtained therefrom; the loss of data or services resulting from delays, non-deliveries, mis-deliveries, or service interruption; the accuracy, quality, timeliness, completeness or nature of information obtained through its services; any omission in the information provided; nor the consequences arising from or related to any viruses transmitted through its servers, or any liability, costs, loss of profits or consequential losses arising from your use of, or inability to access an IT System or the Website.
  3. In relation to content provided by users, AESS will not be responsible for any such content (if any) posted by users in social media sites, chat rooms or other community areas.  All such content whether expressed as opinions, statements or recommendations, are those of users expressing such views and are not those of AESS.
  4. A Website may be linked to or from other sites that are not maintained by AESS or in any way connected to AESS. AESS does not control in any respect any information, products or services offered by such other sites and will NOT be responsible for the content of such other sites. For example, users may be able to buy goods and services via the Website, some of which may be through third party retailers who link to the Website. Users may enter into correspondence with or participate in promotions of advertisers on the Website. AESS in no way endorses these third parties and any such transactions, dealings, correspondence with or participation in promotions of third parties, including the delivery of and the payment for goods and services and any other terms, conditions, warranties or representations associated with such matters are solely between the corresponding user and the third party. AESS assumes no liability, obligation or responsibility for any part of any such transaction, dealing, correspondence or participation.
  5. All copyright in the text, images, photographs, graphics, user interface, and other content provided on the IT Systems or the Website, and the selection, coordination, and arrangement of such content, are owned or licensed by AESS/SLS to the full extent provided under Australian copyright laws and all international copyright laws.
  6. You may view the Website and its contents but you are prohibited from copying, reproducing, modifying, distributing, displaying, performing or transmitting any of the contents of the Website for any purposes without the prior written consent of AESS.  The Website and the information contained in it are for informational purposes only.  Any reproduction, copying, or redistribution for commercial purposes of any material or design elements of the Website is strictly prohibited without AESS’s prior written consent.
  7. The IT Systems and Websites include registered and unregistered trademarks of AESS/SLSA and various third parties, including but not limited to State Surf Life Saving associations and commercial partners of AESS. You may not use these trademarks without the prior written consent of the owner of the relevant trade mark.

Conclusion

By using or logging on to a browser based application, a social media site, a website or other IT System provided by the AESS, State, branch, or Club, the user is agreeing to abide by and act in accordance with this IT Systems Terms of Use Policy. By using an application, database, IT system or website, you acknowledge that the AESS has a right to use any of the information entered into the IT systems by you.

Any breach of this policy will be dealt with under AESS’s rules and any relevant laws pertaining to such breaches. Any breach of this policy may result in disciplinary action being taken by the AESS, States, branches and/or Clubs.

The protection of personal information is important to Surf Life Saving Australia (SLSA).  SLSA is committed to respecting the right to privacy and the protection of personal information.

This document sets out:

  • What personal and sensitive information SLSA collects;
  • How SLSA collects personal and sensitive information;
  • How SLSA uses or discloses personal and sensitive information
  • How individuals can access or seek correction of information held by SLSA ; and
  • Who to contact regarding privacy issues and complaints

By providing your personal information to SLSA, you consent to its use, storage and disclosure in accordance with this Privacy Policy.

This Policy provides for the way in which Surf Life Saving Australia Ltd, its affiliated State Centres, Branches and Clubs (SLSA Affiliates) may collect, use, store and disclose information.  Third party commercial entities and subsidiaries, whether owned or acting on behalf of SLSA or an affiliate or not, may be subject to the same privacy laws and may be governed by their own privacy policies.  SLSA will always do its utmost to ensure that personal information is respected and protected.

What personal and sensitive information does SLSA collect?

Personal Information

Generally, personal information is information or an opinion (including information or an opinion forming part of a database) from which it is possible to determine someone’s identity.

The information collected by a SLSA about a particular person will vary depending on the circumstances of collection.  It may include, but is not limited to, a person’s contact details (name, email and/or postal address, phone number), date of birth, gender, credit card details, driver licence number, passport number, insurance details, employment history, qualifications or communication history with SLSA.

Sensitive Information

Sensitive information is a type of personal information that also includes information or an opinion about:

  • racial or ethnic origin;
  • political opinions;
  • membership of a political association, professional or trade association or trade union;
  • religious beliefs or affiliations or philosophical beliefs;
  • sexual preferences or practices;
  • criminal record; or
  • health, genetic information or disability.

If it is reasonably necessary in the circumstances, SLSA may also collect sensitive information such as a person’s medical history, nationality, their ethnic background or disabilities.

SLSA is required by law to obtain consent when collecting sensitive information.  SLSA will assume consent to the collection of all sensitive information that is provided to it for use in accordance with this Privacy Policy, unless told otherwise.

How does SLSA collect personal and sensitive information?

Information may be collected when you:

  • become a member of a surf life saving club, association or other body which is a member or affiliated with SLSA;
  • subscribe to any publication of SLSA or an SLSA Affiliate, including electronic publications;
  • provide details to SLSA or an SLSA Affiliate in an application form, consent form, survey, feedback form or incident report;
  • enter personal information into, or agree to having your personal information entered into, one of SLSA’s online systems such as ‘Surf Guard’ or another SLSA online system;
  • access the SLSA website;
  • contact SLSA via email, telephone or mail or engage with SLSA via social media;
  • participate in any program, activity, competition or event run by SLSA or an SLSA Affiliate;
  • purchase tickets to a surf life saving or sporting event from SLSA or an authorised agent;
  • purchase merchandise, products or services from SLSA or an authorised agent or licensee;
  • are elected or appointed to the Board or a committee of SLSA or an SLSA Affiliate;
  • apply for employment or a volunteer position with SLSA or an SLSA Affiliate; or
  • where SLSA is required to do so by law (for education, VET training, child protection, Work health and safety laws, AVETMISS, charitable collections, Good Samaritan, Medical Treatment  or other legislation in Australia).

Providing information

Depending on the circumstances, some types of information will be required and others might be optional. If you do not provide some or all of the information requested, this may affect SLSA’s ability to communicate with you or provide the requested products or services.

By not providing requested information, you may jeopardise your ability to participate in programs or competitions or apply for employment or volunteer positions with SLSA or an SLSA Affiliate.  If it is impracticable for SLSA to deal with you as a result of you not providing the requested information or consents, SLSA may refuse to do so.

Collection from third parties

SLSA or an SLSA Affiliate may collect personal information regarding a child from the parent or other responsible person associated with that child.

In some circumstances, SLSA collects information from SLSA Affiliates or other third parties.

Examples of such third parties could include, without limitation, the Australian Institute of Sport, the Australian Olympic Committee, non-affiliated surf life saving organisations or government and law enforcement bodies.

Information storage and protection

SLSA stores information in different ways, including in paper and electronic form. Much of the information we collect from and about our members is added to our ‘Surfguard’ database which is hosted by a third party data storage provider. When your information is entered into the Surfguard database, the information may be combined or linked with other information held about you.

Security of personal information is important to SLSA.  SLSA has taken steps to protect the information we hold from misuse, loss, unauthorised access, modification or disclosure. Some of the security measures SLSA uses includes strict confidentiality requirements of our employees, volunteers, SLSA Affiliates and service providers, as well as security measures for system access, and security measures for our website such as firewalls and system encryption.

How does SLSA use and disclose personal and sensitive information?

Use

SLSA, and third parties to whom we may disclose personal information in accordance with this Privacy Policy, may use your personal information to:

  1. verify your identity;
  2. complete background checks;
  3. research, develop, run, administer and market competitions, programs, activities and other events relating to a variety of surf life saving sports and activities including but not limited to ‘Nippers’, ‘Rescue and Resuscitation’ events, Ironman and Ironwoman competitions, emergency management information, membership management, education offerings and organisation, social events, police or other legal agencies for the purposes of medical treatment amongst others;
  4. research, develop and market products, services, merchandise and special offers made available by us and third parties;
  5. respond to emergency situations involving or requiring medical treatment;
  6. administer, manage and provide you with access to sls.com.au , ‘Surfguard’ database, self service portal and other IT based applications; and
  7. keep you informed of news and information relating to various surf life saving events, activities and opportunities via various mediums.

SLSA may use health information to ensure that programs we operate are run safely and in accordance with any special health needs participants may require.  Health information may also be kept for insurance purposes. In addition, we may use de-identified health information and other sensitive information to carry out research, to prepare submissions to government or other regulatory bodies, or to plan events and activities.

Disclosure

SLSA may disclose your personal information to a range of organisations which include, but are not limited to:

  • SLSA Affiliates and other organisations involved in surf life saving and emergency management;
  • companies we engage to carry out functions and activities on SLSA’s behalf, including direct marketing;
  • our professional advisers, including our accountants, auditors and lawyers;
  • our insurers;
  • SLS companies, subsidiaries and affiliates;
  • relevant sporting bodies such as the Australian Sports Commission, the Australian Sports Anti-Doping Authority, the Australian Olympic Committee, the Australian Paralympic Committee, the Australian Commonwealth Games Association, Australian Institute of Sport, Australian Sports Anti-Doping Authority, various National Sporting bodies, and Federal and State Departments of sport amongst others; and in other circumstances permitted by law.

In some circumstances, personal information may also be disclosed outside of Australia. In such circumstances, SLSA will use its best endeavours to ensure such parties are subject to a law, binding scheme or contract which effectively upholds principles for fair handling of the information that are suitably similar to the Australian Privacy Principles.

Direct marketing

SLS will assume consent to use non-sensitive personal information to provide to you better services and marketing purposes (including disclosure of such information to service providers).

Every person whose data is collected by SLSA has the option to refuse e-mail, SMS or posted offers.  You may do this by updating the direct marketing settings in your user portal/Life Saving Online in SurfGuard, or via the opt-out procedures included in any communication from us (information relating to the option to unsubscribe from those communications may be retained).

Other disclosures

In addition, SLSA may also disclose personal information:

  1. with your express or implied consent;
  2. when required or authorised by law;

to an enforcement body when reasonably necessary; or

to lessen or prevent a threat to an individual or public health or safety.

SLSA website

When users visit the SLSA website, our systems may record certain information about their use of the site, including the web pages visited and the time and date of their visit. SLSA uses this information to help analyse and improve the performance of the SLSA website.

In addition, we may use “cookies” on the SLSA website. Cookies are small text files that help a website to remember the preferences of users to improve the experience of using that website. In some cases, the cookies that we use may collect some personal information. SLSA will treat this information in the same way as other personal information we collect. You are free to disable cookies on your internet browser to prevent this information being collected; however, you may lose the benefit of an enhanced website experience that the use of cookies may offer.

Websites linked to the SLSA website are not subject to SLSA’s privacy standards, policies or procedures.  SLSA does not take any responsibility for the collection, use, disclosure or security of any personal information that you provide to a third party website.

Accessing and seeking correction of information held by SLSA

SLSA will take all reasonable steps to ensure that the personal information it collects, uses or discloses is accurate, complete and up-to-date. However, we rely on the accuracy of personal information as provided to us both directly and indirectly.

SLSA also relies on Affiliates and volunteers to enter data and make their best endeavours to ensure data is accurately recorded.

We encourage all users to regularly review and update their personal information on the Surfguard database and via the “members portal” link.

Individuals may also request access to their personal information held by us by making a request via the contact details set out below. We will respond to your request for access within 14 days and endeavour to provide the requested information within 30 days. If you find that the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will see that it is corrected.

Resolving privacy issues and complaints
